The short version. We coach, we do not treat. See a doctor before you start and tell us about anything that affects your training. Your program has a fixed term and a fixed price, and a payment plan is just a way of spreading that price. There are no change-of-mind refunds, but nothing here takes away your rights under the Australian Consumer Law. Our programs, recipes, calculators and downloads are ours; use them for yourself and do not share them. Be decent in the community. If something goes wrong, talk to us first.
1.1 These terms are between Fitness Unicorn Coaching Pty Ltd (ABN 46 680 606 544, ACN 680 606 544), trading as Unicorn Nation and Unicorn Academy (we, us, our), and you.
1.2 They apply whenever you use our website (unicorn-nation.com and related pages), buy or take part in a Program, download or use a Resource, attend an Event or buy Merchandise. We ask you to confirm that you agree to them when you buy a Program or complete your onboarding.
1.3 You must be at least 18 years old and able to enter a binding agreement. Our Programs are designed for women aged 30 and over, but adults of any age may buy them.
1.4 If you sign a separate Client Agreement for a Program, the Client Agreement applies together with these terms. If the two conflict, the Client Agreement wins for that Program.
1.5 These terms are a standard-form consumer contract. We have tried to keep them balanced and in plain language. Nothing in them excludes, restricts or modifies any right you have under the Australian Consumer Law or any other law that cannot be excluded.
3.1 1:1 coaching. A personalised training program delivered through the Everfit app, nutrition guidance for your goals, technique feedback, program updates (typically every 4 weeks, and earlier if your check-ins call for it), check-ins, coaching calls, group calls, a resource library and access to our community. What is included depends on the Program level you buy and is confirmed at checkout or in your Client Agreement.
3.2 Unicorn Academy. A group program delivered through the Everfit app with structured training, nutrition education, community access and group support for a 16-week term, then week to week if you keep your subscription.
3.3 Resources. Free and paid content, some of which asks for your name and email in return.
3.4 Events and Merchandise. As described on the relevant sales page.
3.5 We are coaches, not clinicians. Nothing we provide is medical advice, a diagnosis, treatment, physiotherapy, psychological care or medical nutrition therapy. Our coaches are qualified fitness and nutrition coaches, not doctors, dietitians or psychologists, unless a coach tells you otherwise in writing about their own registration. Our nutrition guidance is general education and coaching for healthy adults. It is not a prescribed diet for a medical condition.
3.6 Results are not guaranteed. Everyone responds differently. We do not promise any particular change in weight, body composition, strength, health markers or performance. Any results we show are individual results and do not predict yours.
3.7 We may improve, reorganise or replace parts of a Program, the app, our resource library or our methods during your Term, provided the Program remains substantially what you bought.
4.1 See a doctor first. Before starting any Program or using any Resource, get clearance from a doctor or other qualified health professional if you have, or think you might have, any medical condition, injury, are pregnant or recently gave birth, are on medication that affects exercise or diet, or have a history of disordered eating.
4.2 Tell us the truth. You must answer our onboarding questions, the Medical and Training Survey and check-ins honestly and completely, and tell us promptly about any change in your health, injuries, pregnancy, medications or circumstances. We design your Program on what you tell us. If you leave something out, we cannot allow for it.
4.3 We may ask for clearance. If anything you tell us suggests coaching may not be safe for you without medical input, we may ask for written clearance from your health professional, adjust your Program, or decline or delay coaching until we have it. We will not refuse to work with you simply because you have a condition. We will work with you and your health professional to find a safe way, or tell you honestly if we cannot.
4.4 You choose what you do. You decide which exercises to do, how much weight to lift and when to stop. If something hurts, feels wrong, or you feel faint, dizzy, short of breath or unwell, stop immediately and seek medical help if needed. Never train through pain because a program says so.
4.5 Your environment is yours. You are responsible for your training space, equipment, technique in your own sessions, food choices, hydration and rest. We cannot see your sessions in real time.
4.6 Emergencies. We are not an emergency or crisis service. In Australia call 000 for emergencies. Lifeline is 13 11 14 and the Butterfly Foundation (eating disorders) is 1800 33 4673. If you live outside Australia, call your local emergency number or crisis line.
4.7 Supplements. If we mention a supplement, it is general information, not a recommendation to take it. Check with your doctor or pharmacist, especially if you take medication or are pregnant.
5.1 Licence. When you download or use a Resource, we give you a personal, non-transferable, non-exclusive licence to use it for your own health and fitness. You must not copy it for others, share it, post it, sell it, use it to coach or train other people, or use it in a business, unless we agree in writing.
5.2 General information only. Free Resources are general education. They are not written for you and do not take your health into account. Clauses 3.5, 3.6 and 4 apply to Resources exactly as they apply to Programs.
5.3 The calorie calculator and other tools. Our calculators, quizzes and scorecards give estimates based on population formulas and the numbers you type in. They are a starting point for a conversation, not a prescription. The calorie calculator does not know your medical history and does not apply a safety floor. Do not follow a calorie target that a health professional has told you is unsafe for you, and do not use the calculator at all if you are under 18, pregnant or breastfeeding, or have a history of disordered eating, unless a health professional has told you it is appropriate.
5.4 As is. Free Resources are provided as is. We take care to make them accurate but do not promise they are error-free, complete or suitable for you. We may change, update or withdraw any Resource at any time.
5.5 Your email. When you give us your details to receive a Resource, you agree we may email or message you about that Resource and related tips, programs and offers. Every message has an unsubscribe link and you can opt out at any time. See our Privacy Policy for how we handle your details.
5.6 Paid Resources (for example a paid program download or ebook) are digital content. Because you receive them immediately, there is no change-of-mind refund once delivered, subject to clause 9.4.
6.1 Programs are delivered mainly through the Everfit app. To use it you need a compatible phone or computer, internet access and an Everfit account. Everfit's own terms and privacy policy, and the Apple App Store or Google Play terms, apply to your use of the app. We are not responsible for Everfit or any other Platform being unavailable, changing its features or losing data, but we will do what we reasonably can to restore your access and content.
6.2 Keep your login details private and tell us straight away if you think someone else has used your account. You are responsible for activity under your login until you tell us.
6.3 We may move a Program to a different app or platform during your Term if we need to, provided the Program remains substantially what you bought. We will give you reasonable notice and help you move.
6.4 Your Program, community and app access ends when your Term ends or your Program is cancelled, unless you renew.
7.1 Price. The price and the payment options for a Program, Event or Merchandise are shown at checkout, on the sales page or in your Client Agreement. Prices in Australian dollars include GST where it applies. Prices in US dollars or British pounds are for clients outside Australia and do not include Australian GST. You are responsible for any taxes, bank fees or currency conversion charges your own bank applies.
7.2 Payment options. Depending on the Program you may pay in full, in a set number of instalments, or by monthly or weekly direct debit. All payments are processed by Stripe. We do not see or store your full card number.
7.3 Payment plan authority. When you choose a payment plan or subscription, you authorise us, through Stripe, to charge your nominated card or bank account on each scheduled date for the amounts shown at checkout, until the plan is complete or the subscription is cancelled under clause 9. If you pay by bank debit, Stripe's direct debit service agreement also applies. Keep your payment details up to date. You can update them through the link in any Stripe receipt or by contacting us.
7.4 What the plan is. For a fixed-Term Program, a payment plan is a way of paying the full Program price over the Term. It is not a pay-as-you-go membership. See clause 8.
7.5 Failed payments. If a scheduled payment fails, we will let you know and Stripe will retry it up to 3 times over the following 14 days. If it is still unpaid after 14 days, we may pause your app and coaching access until it is paid. Your Term and your remaining payment dates do not change while access is paused for non-payment. We may pass on the dishonour fee our bank or Stripe actually charges us for a failed payment. We do not charge interest.
7.6 Unpaid Fees. If Fees remain unpaid, we may recover them, including through a collection agency or court, and recover the reasonable costs of doing so where the law allows.
7.7 Chargebacks. Please contact us before disputing a charge with your bank or card issuer. If you dispute a charge for Fees you owe under these terms, we may suspend your access while the dispute is resolved and provide your bank with evidence of your purchase and these terms.
7.8 Price changes. We may change our prices at any time for new purchases. A price change never affects a Term you have already bought. It applies only to a renewal or new purchase you choose to make after we tell you the new price.
7.9 Deposits. Where a deposit holds your place in a Program or Event, it is applied to your Fees. Whether it is refundable is stated when you pay it and in clauses 9 and 18.
8.1 1:1 Programs run for the fixed Term you buy (usually 6 months). Your start and end dates are confirmed when you are onboarded. The full Program price for the Term is payable whether you pay up front or by a payment plan.
8.2 If you stop early. If you stop taking part, stop checking in or ask to leave before the end of your Term, the Program is still yours to use until the end date and the remaining instalments stay payable on their scheduled dates. We will not demand the remaining balance as a lump sum, but you may pay it out early at any time. This does not limit clauses 9.4 (Australian Consumer Law), 9.5 (hardship) or 9.6 (overseas cooling-off).
8.3 Unicorn Academy has a 16-week minimum Term. If you pay in full, your membership continues week to week when your Term ends, at the weekly rate shown at checkout and in your reminder emails, charged to the card you paid with. We email you 4 weeks and 1 week before your Term ends. If you do not want to continue, tell us before your Term ends and nothing more is charged. After that you can cancel at any time under clause 9.3. If you pay weekly, your subscription continues week to week after the Term until you cancel under clause 9.3. The full 16-week Fee is payable whether you pay up front or weekly; weekly payments during the Term are a payment plan for that Fee.
8.4 Your Term is extended by the length of any pause we approve under clause 10.
9.1 Change of mind. We do not offer refunds, credits or transfers because you change your mind, do not use the Program, stop checking in, or your circumstances or priorities change. The only exception is a written money-back guarantee stated on the sales page for your Program at the time you buy. If there is one, it applies on its stated terms and you claim it by emailing us within the stated period.
9.2 1:1 Programs. You may tell us at any time that you want to stop. Clause 8.2 explains what happens to your access and payments.
9.3 Academy weekly subscription. After your 16-week Term you can cancel at any time by emailing admin@unicorn-nation.com or messaging your coach in the app. Your cancellation takes effect at the end of the week you have already paid for. You will not be charged again after that, and the week already paid is not refunded. We will confirm your cancellation in writing within 2 business days. If you do not receive a confirmation, assume we did not receive your request and contact us again.
9.4 Australian Consumer Law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion. If we cannot deliver a Program you have paid for, we will refund the part we cannot deliver.
9.5 Hardship. If a serious medical condition, injury, pregnancy complication, bereavement or similar major event means you genuinely cannot continue, tell us and show us reasonable supporting evidence. We may, at our discretion, pause your Program under clause 10, move you to a lighter Program, release you from some or all remaining instalments, or offer a partial credit. We will always consider a genuine hardship request fairly. Apart from your rights under clause 9.4, any release or refund under this clause is at our discretion.
9.6 Overseas cooling-off. If you live in the United Kingdom or the European Union and buy online, you have a legal right to cancel within 14 days of purchase. If you ask us to start your Program during those 14 days (for example by completing onboarding), you agree that we start immediately, and if you then cancel within the 14 days you pay only for the part of the Program delivered up to your cancellation, worked out on a daily basis, and we refund the rest. Nothing in these terms removes any right you have under the consumer law of the country you live in that cannot be excluded.
9.7 How we refund. Any refund we agree to or owe is paid to the original payment method within 10 business days of our confirmation. Currency conversion differences and your bank's fees are not refundable.
10.1 You can ask to pause a 1:1 Program. Pauses are granted at our reasonable discretion, normally for up to 8 weeks in any Term, and longer by agreement in a genuine hardship case.
10.2 When we approve a pause, your Program end date moves out by the length of the pause, and one of the following applies. We will tell you which when we confirm the pause:
10.3 We cannot pause a Program while a payment is overdue or a chargeback is open. If you simply stop engaging without asking for a pause, your Program continues, your end date does not move and your Fees stay payable.
10.4 Academy weekly subscriptions cannot be paused. Cancel under clause 9.3 and rejoin when you are ready, at the price current at that time.
11.1 1:1 Programs do not renew automatically. Towards the end of your Term we may offer you a renewal, often at a discount. A renewal is a new agreement on these terms and starts only when you accept it in writing (email, app message or direct message) or by paying.
11.2 Continuing on a payment plan. If you agree to continue after your Term on a new price or Program without signing a new Client Agreement, we will confirm the new price, number of payments, Program and end date to you in writing before the first new payment, and send you a reminder before that payment is charged. If you do not want to continue, tell us before the first new payment and nothing further is charged.
11.3 Academy. We will remind you before your 16-week Term ends. After that your weekly subscription continues until you cancel under clause 9.3.
12.1 Programs are personal to you. You cannot transfer, gift, share or resell a Program, a place in an Event, or your app access to anyone else.
12.2 You can ask to upgrade (for example from the Academy or Training Only to ALL IN) at any time. We will confirm the price difference and any change to your Term in writing before it takes effect.
12.3 Downgrades during a Term are at our discretion. A downgrade does not reduce Fees already paid or payable for the current Term unless we agree in writing.
13.1 To get what you paid for, you agree to:
13.2 If you do not engage, check in or provide information, we will do our best to support you but cannot deliver the same results, and this does not entitle you to a refund, credit or extension.
14.1 Coaching communication happens through the Everfit app and scheduled calls. You can message any time. Coaches reply on business days (Monday to Friday, Australian Eastern time, excluding public holidays) and aim to respond within 1 business day. Check-in feedback is given within 2 business days of a complete check-in.
14.2 Replies are not immediate or guaranteed at a particular time. We publish holiday closures in the app and on our website; response times pause during closures.
14.3 Calls are booked through our booking system. If you need to move or miss a call, let us know and we will rebook it. There is no notice period.
14.4 We may record coaching and sales calls for your program notes, quality and training. We will tell you at the start of any recorded call and you can ask us not to record. See our Privacy Policy.
15.1 Our community spaces (in the app, on calls, at Events and in any other group space we run) are for support and connection. In them you agree to:
15.2 We moderate our community spaces. We may remove content and, for a serious or repeated breach, remove your access to community spaces for the rest of your Term without refund. Your coaching continues unless clause 21 applies.
16.1 Everything we create, including Programs, training plans, videos, recipes, guides, calculators, quizzes, templates, branding and course content, belongs to us or our licensors and is protected by copyright and other laws. Our coaching processes and know-how are also our confidential information.
16.2 While you are in a Program you have a personal, non-transferable licence to use the materials for your own training. For Resources you downloaded, the licence in clause 5.1 continues after your Program ends.
16.3 You must not copy, share, publish, sell, adapt, translate, scrape, or use any of our materials to train or coach others or to build a competing product, and you must not share your app login. A serious breach of this clause is a ground for us to suspend or end your Program under clause 21, and we reserve all our other rights.
16.4 Content you post in our community or send us stays yours. You give us a licence to store, display and use it to deliver the Program and run the community. Publishing it elsewhere needs your consent under clause 17.
17.1 Your progress photos, measurements, check-ins and results are health information. We use them only to coach you, unless you give us separate written consent to publish them.
17.2 If we would like to feature your story, photos or results in our marketing, we will ask you first. Our request will say where it will be used (for example Instagram, our website or ads) and for how long, and you can say no without affecting your coaching. Consent is given by a separate, unticked box or a clear written yes, never by default.
17.3 You can withdraw consent at any time by emailing us. We will stop using the content in new material within 10 business days and remove it from places we control. We cannot recall copies already downloaded or shared by others.
17.4 If you tag us or post publicly about us on social media, you agree we may reshare that public post on our own channels with credit to you, and you can ask us to remove it at any time.
17.5 Any results we publish are the individual's own results. We do not claim they are typical.
18.1 Each Event has its own details on its sales page (dates, location, inclusions, price, deposit and payment plan, and the Event's change and cancellation policy). Those details form part of your agreement for that Event, together with this clause.
18.2 If you cancel. Unless the Event page says otherwise, your deposit is non-refundable if you cancel, because we commit to venues, travel and catering on the strength of it. If you cancel, no further instalments will be charged, and we will refund any instalments you have paid beyond the deposit, less any non-refundable costs we have already committed to for your place (we will show you these). If we fill your place from a waiting list, we will also refund your deposit, less our reasonable costs.
18.3 If we change or cancel. If we cancel an Event, you may choose a full refund or a credit. If we make a major change (for example a different date or location) you may cancel for a full refund. Minor changes to the schedule or activities do not entitle you to a refund.
18.4 Events beyond our control. If an Event cannot go ahead safely because of something outside our reasonable control (for example a natural disaster, public health order, venue closure or travel disruption), you may choose a transfer to a new date, a credit, or a refund of what you have paid less any non-refundable costs we have already incurred for your place that we cannot recover from suppliers. We are not liable for your own travel or other costs, so please hold travel insurance.
18.5 Taking part. Physical activities at an Event carry risk. Clause 4 applies. You must complete our medical form before an Event, follow instructions from our team and venue staff, and behave responsibly, including around alcohol. We may remove anyone who endangers themselves or others, without refund. You are responsible for your own belongings and travel arrangements.
18.6 Third parties. Venues, accommodation, transport and activity providers are independent businesses with their own terms. We choose them with care but do not control them.
18.7 Minimum numbers. Some Events need a minimum number of participants. If we cancel for that reason we will tell you at least 30 days before the Event where possible and clause 18.3 applies.
19.1 Merchandise is described and priced on the sales page. Delivery costs are shown before you pay. Delivery times are estimates. Risk in the goods passes to you on delivery to the address you gave us.
19.2 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
19.3 We do not offer change-of-mind returns on Merchandise. If an item arrives faulty, damaged or not as described, contact us within a reasonable time with photos and your order number and we will arrange a replacement or refund, and refund your reasonable return postage where the claim is valid.
20.1 Your consumer rights come first. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
20.2 What we are not responsible for. To the extent the law allows, we are not liable for loss or harm that results from: information you did not give us or gave us inaccurately; you not following your health professional's advice or our safety guidance; exercises, loads, foods or supplements you chose to use against our guidance; your equipment or training environment; the acts or omissions of a Platform, venue or other third party we do not control; or events outside our reasonable control.
20.3 Indirect loss and cap. To the extent the law allows, we are not liable for indirect or consequential loss, loss of income or profit, or loss of opportunity, and our total liability to you for all claims connected with a Program, Resource, Event or Merchandise is limited to the Fees you paid for it in the 12 months before the claim. This cap does not apply to liability that cannot be limited by law or to personal injury caused by our negligence, except as set out in clause 20.4.
20.4 Recreational services. Our training and exercise services are recreational services for the purposes of section 139A of the Competition and Consumer Act 2010 (Cth). To the extent that section allows, we exclude liability for death or personal injury (including physical or mental injury, and the aggravation of an existing condition) that results from a failure by us to comply with the consumer guarantees for those services. This exclusion does not apply where the failure was caused by our reckless conduct, does not apply to our nutrition guidance, and does not apply to any loss that is not death or personal injury.
20.5 Your responsibility to us. You agree to compensate us for loss we suffer that is caused by your breach of these terms or your unlawful act, reduced to the extent we contributed to the loss.
21.1 By us. We may suspend your access or end your Program if you: seriously or repeatedly breach these terms; are abusive or threatening to our team or members; share or misuse our materials; do not pay Fees after we have told you they are overdue and given you 14 days to pay; or act in a way that puts your safety or someone else's at risk. Except in an urgent safety case, we will tell you the problem and give you a reasonable chance to fix it first.
21.2 If we end your Program because of your breach, Fees already paid for the period up to the date we end it are not refunded, no further instalments are charged after that date, and we may recover our reasonable losses caused by your breach. This is subject to your rights under clause 9.4. If we end your Program for any other reason, we refund the unused part of your Fees.
21.3 By you. You can stop at any time by telling us in writing. Clauses 8 and 9 explain what happens to your access and payments.
21.4 When a Program ends, your app, community and coaching access ends. Downloaded Resources stay yours to use under clause 5.1. We keep your records as described in our Privacy Policy.
22.1 Our coaches, sales team and support staff include independent contractors. All of them are bound by confidentiality and our privacy obligations and are trained in our methods. We are responsible to you for the coaching we deliver through them.
22.2 We may change your coach during your Term, for example if a coach is away, leaves, or we think another coach is a better fit. We will tell you and make the handover as smooth as we can. A coach change is not a ground for a refund.
22.3 Our coaches work for you through us. Any private arrangement between you and a coach outside your Program is not our service and we are not responsible for it.
23.1 Our Privacy Policy at unicorn-nation.com/privacy explains what personal and health information we collect, how we use and store it, who we share it with (including team members and service providers overseas), and how you can access or correct your information or make a complaint.
23.2 We collect health information (such as your medical and training history, injuries, measurements, progress photos and check-ins) only with your express consent, which we ask for separately when you onboard. You can withdraw that consent at any time, but we may then be unable to coach you safely, and clause 9 applies.
23.3 We handle your personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
24.1 We may update these terms from time to time, for example when the law changes or we add a new service. The current version is always at unicorn-nation.com/terms-of-service with its date.
24.2 We will give you at least 30 days' notice of a material change by email or app message. A change does not apply to a fixed Term you have already paid for if it would reduce what you get or increase what you pay. If a change materially disadvantages you on an ongoing subscription, you may cancel without penalty before it takes effect.
24.3 Continuing to use our services after a change takes effect means you accept it for the future.
25.1 If something is wrong, tell us first at admin@unicorn-nation.com with the details. We will acknowledge you within 2 business days and aim to resolve the issue within 14 days. Most issues are fixed with a conversation.
25.2 If we cannot resolve it, you can contact your local consumer protection body (in the ACT, Access Canberra; in other states and territories, the fair trading office) or, for privacy matters, the Office of the Australian Information Commissioner. Nothing in this clause stops you exercising any right under the Australian Consumer Law or going to a court or tribunal.
25.3 Both of us agree to try in good faith to resolve any dispute directly before starting court proceedings, except where urgent relief is needed.
27.1 We welcome clients around the world. If you live outside Australia, you may have rights under the consumer laws of your own country that cannot be excluded. Nothing in these terms takes those away, and clause 9.6 applies to United Kingdom and European Union residents.
27.2 Prices in US dollars or British pounds are charged in that currency. Your bank sets any conversion rate and fees.
27.3 Programs are designed and delivered from Australia. Coaching hours, holidays and response windows are in Australian Eastern time.
27.4 If you live in the United States, the laws of your state may give you rights about automatic renewals and cancelling a subscription online. Nothing in these terms limits those rights.
These terms are governed by the laws of the Australian Capital Territory and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of the Australian Capital Territory, which means you can still bring a claim in your local court or tribunal where the law allows.
